Terms of Service
These terms are between you and Context Aware LLC, a California limited liability company (“we”, “us”), which makes Petri Dish (“the app”) under the Nordaware name. By buying, installing or using the app, you agree to them. Please read them alongside our privacy policy.
For parents and guardians
Petri Dish is made for children aged 6 and up. If the app is for a child, the adult who buys it or sets it up accepts these terms for them and decides how the child uses it.
The app is built to be safe to hand to a child. It has no ads, no accounts, no chat, no sharing, no links out of the app and nothing to buy inside it. It has no internet access, and it collects no information about your child or anyone else.
What the app is
The app is an animated drop of pond water seen through a microscope. Children can tap a creature to see its card, collect the creatures they have spotted in a field guide, and zoom and focus the view. It also includes a live wallpaper that shows the same drop of water behind the home screen.
The creatures are drawn and animated, not filmed, and their cards explain real science in simple words for children. The app is meant to spark curiosity. It is not a scientific reference, and it is not medical or safety advice about real pond water.
Buying the app
The app is sold as a one-time purchase on Google Play. Google handles the payment, and theGoogle Play Terms of Service apply to it as well as these terms. Refunds are handled by Google underGoogle Play's refund policy. If something goes wrong with a purchase, you can also write to us and we will help where we can.
Nothing is sold inside the app, and buying it once unlocks everything in it. The purchase belongs to the Google account that made it, so parental controls and purchase approvals you have set up in Google Play apply as usual.
If you live in the European Union, the United Kingdom or another place whose consumer laws give you a right to cancel or withdraw from a purchase of digital content, you keep that right as those laws set it out. Google Play explains how such requests work.
Promo codes
We sometimes give the app away with Google Play promo codes. A code is redeemed through Google Play under Google's terms, is good for one copy of the app, has no cash value and may not be sold. A code may stop working after the date Google Play shows for it.
Your licence
When you buy the app, we give you a personal, non-exclusive, non-transferable licence to use it on Android devices you or your family own or control, as Google Play allows. You may not copy, sell, rent or redistribute the app, or reverse-engineer it, except where the law allows you to regardless of these terms.
Using the app
Please use the app only in ways that are lawful. Don't try to get around the way it is licensed through Google Play.
The live wallpaper uses some battery while it is on screen. It animates only while you can see it, and how much battery it uses depends on your phone.
Field-guide progress is kept on the device. Uninstalling the app or clearing its storage erases it, and it can come back only through Android's own backup, if you use it.
Ownership
The app, its creatures, artwork, text and code belong to Context Aware LLC. Nordaware is our trademark. Google Play and Android are trademarks of Google LLC. These terms don't give you any rights in our trademarks or artwork beyond what you need to use the app.
Updates
We may update the app to fix problems, add or change creatures and features, or keep it working with new versions of Android. Updates come through Google Play. We won't add ads or in-app purchases to the copy you bought without changing these terms first.
No warranty
We work hard to make the app reliable, but apart from the guarantees the law gives you and that cannot be excluded, the app is provided “as is”. We don't promise that it will be free of errors or that it will work on every device.
Limitation of liability
To the extent the law allows, Context Aware LLC is not liable for indirect, incidental or consequential losses arising from your use of the app, and our total liability to you for the app is limited to the amount you paid for it.
Nothing in these terms limits or excludes liability that the law does not allow us to limit or exclude, such as liability for fraud or, where the law provides for it, for death or personal injury caused by negligence.
Your rights as a consumer
If you are a consumer, you keep all the rights that the consumer laws of the place you live give you, and nothing in these terms takes them away. That includes, in the European Union and the United Kingdom, your right to digital content that works as described.
Ending
You can stop using the app at any time by uninstalling it. If you break these terms in a serious way, your licence to use the app ends.
Law and disputes
These terms are governed by the laws of the State of California, USA. If you are a consumer living in the European Union, the United Kingdom or elsewhere, you also keep the protection of the mandatory laws of your country, and you may bring a claim in the courts where you live. Before anything formal, please write to us: most problems can be sorted out by email.
Changes to these terms
If we change these terms, we will post the new version on this page and update the date at the top. Changes won't take away rights you already have for a purchase you have made.
