Terms of Service
These terms are between you and Context Aware LLC, a California limited liability company (“we”, “us”), which makes Animated Fractal Wallpaper Art (“the app”) under the Nordaware name. By buying, installing or using the app, you agree to them. Please read them alongside our privacy policy.
What the app is
The app is a set of animated live wallpapers for Android that you can adjust in its settings screen. The wallpapers are generated on your phone as they play. The app has no accounts and no ads, and it does not need an internet connection to work.
Buying the app
The app is sold as a one-time purchase on Google Play. Google handles the payment, and theGoogle Play Terms of Service apply to it as well as these terms. Refunds are handled by Google underGoogle Play's refund policy. If something goes wrong with a purchase, you can also write to us and we will help where we can.
If you live in the European Union, the United Kingdom or another place whose consumer laws give you a right to cancel or withdraw from a purchase of digital content, you keep that right as those laws set it out. Google Play explains how such requests work.
Your licence
When you buy the app, we give you a personal, non-exclusive, non-transferable licence to use it on Android devices you own or control, as Google Play allows. You may not copy, sell, rent or redistribute the app, or reverse-engineer it, except where the law allows you to regardless of these terms.
Using the app
Please use the app only in ways that are lawful. Don't try to get around the way it is licensed through Google Play, or use it to harm anyone else.
A live wallpaper uses some battery while it is on screen. The app is built to be light on battery, and how much it uses depends on your phone and the settings you choose.
Pictures and clips you make
The app can make a picture or a short clip of a wallpaper, which you can save to your phone or share through Android's share sheet. Each one carries the app's name in a corner, and sharing adds a line with the app's Google Play link.
You may keep, post and share these pictures and clips freely, including on social media. We don't receive them: they are made on your phone and go only where you send them. You are responsible for where you share them and for what you add to them.
Ratings
From time to time the app may show Google Play's own rating sheet. Rating the app is always optional. Any rating or review you leave is posted through Google Play under Google's terms.
Ownership
The app, its wallpapers, artwork and code belong to Context Aware LLC. Nordaware is our trademark. Google Play and Android are trademarks of Google LLC. These terms don't give you any rights in our trademarks or artwork beyond what you need to use the app and share what you make with it.
Updates
We may update the app to fix problems, add or change wallpapers and settings, or keep it working with new versions of Android. Updates come through Google Play.
No warranty
We work hard to make the app reliable, but apart from the guarantees the law gives you and that cannot be excluded, the app is provided “as is”. We don't promise that it will be free of errors or that it will work on every device.
Limitation of liability
To the extent the law allows, Context Aware LLC is not liable for indirect, incidental or consequential losses arising from your use of the app, and our total liability to you for the app is limited to the amount you paid for it.
Nothing in these terms limits or excludes liability that the law does not allow us to limit or exclude, such as liability for fraud or, where the law provides for it, for death or personal injury caused by negligence.
Your rights as a consumer
If you are a consumer, you keep all the rights that the consumer laws of the place you live give you, and nothing in these terms takes them away. That includes, in the European Union and the United Kingdom, your right to digital content that works as described.
Ending
You can stop using the app at any time by uninstalling it. If you break these terms in a serious way, your licence to use the app ends.
Law and disputes
These terms are governed by the laws of the State of California, USA. If you are a consumer living in the European Union, the United Kingdom or elsewhere, you also keep the protection of the mandatory laws of your country, and you may bring a claim in the courts where you live. Before anything formal, please write to us: most problems can be sorted out by email.
Changes to these terms
If we change these terms, we will post the new version on this page and update the date at the top. Changes won't take away rights you already have for a purchase you have made.
